A lawsuit has been filed in the Supreme Court of the State of New York in order to protect eh business model of the Free Poker Experience, a free poker bar league looking to operate in New York State. According to the lawsuit and a press release by the Free Poker Experience, the law is "arbitrary and capricious" and selectively applied, and the lawsuit is hoping to change that. In an interesting move the Free Poker Experience is trying to establish the legality of poker before setting up shop, stating they do not want to jeopardize their own legal status or the liquor licenses of the establishments they would do business with.
