The current state of poker in the state of North Carolina is that it is an illegal gambling activity, but a recent ruling by a Durham judge that locks in poker as a game of chance is being challenged by those who say it is skill, not chance, that defines the game. Howard Fierman, a Durham businessman, is leading the charge, and as a result the case is now at the State Court of Appeals. Should the case establish poker as a game of skill, as Fierman intends, he would then be able to open a poker hall in Durham.
As an example that poker is governed by skill Whit Powell, Fierman's attorney, pointed out that should he play a game of poker with expert players, he would likely lose every time.
